In the published portion of the opinion, the Court of Appeal held that on remand from the Supreme Court Public Resources Code, § 21168.9 did not empower the appellate court to issue its own writ of mandate and supervise the agency’s compliance. Rather, the Court of Appeal was limited to deciding issues pertinent to the scope of the writ of mandate and then remitting the matter to the trial court.
