With a practice focused on environmental, regulatory and general civil litigation matters, Todd Smith, Of Counsel, has particular experience advising clients on land use permitting and California Environmental Quality Act compliance.

Todd brings to Thomas Law Group extensive experience working with clients on the application and effect of environmental, land use, and administrative laws, including the California Environmental Quality Act, National Environmental Policy Act, Clean Water Act, Clean Air Act, Endangered Species Act, Federal Land Policy Management Act, Global Warming Solutions Act of 2006 (AB 32) and the Warren-Alquist Act.

He represents clients in proceedings before federal, state and local agencies throughout California, including administrative hearings concerning permit rights and appeal, and has extensive litigation experience in challenging or defending agency actions in mandamus or A.P.A-type lawsuits.

Todd’s recent experience as Counsel with Pillsbury Winthrop Shaw Pittman LLP includes advising the Chevron Richmond refinery concerning local, state, and federal investigations stemming from, as well as repair efforts, necessitated by the 2012 industrial accident at the facility.

With litigation related to a $1 billion infrastructure upgrade at the refinery, Todd acted as the lead associate for project permitting activities and litigation related to the construction on that modernization project. Todd also has prior experience representing public agency clients, including acting as lead associate for the $500 million extension of the Bay Area Rapid Transit Agency’s (BART) line to the city of Antioch. This involved extensive drafting and review of the EIR, drafting and negotiating agreements concerning environmental entitlements, and daily case management and client interactions.

Additional work with public entities includes acting as lead associate for permitting and environmental review of ten school construction projects for the Los Angeles Unified School District, and serving as first chair in administrative proceedings for the city of Hayward opposing a power plant sitting.

Prior to Pillsbury, Todd was with Bingham McCutchen LLP, and also Ragghianti Freitas LLP.

Todd earned his Juris Doctor from the University of California, Hastings College of Law, and has a Bachelor of Arts degree in humanities, with a minor in English and writing from Dominican University of California.
